05-12-03 : The Alaska State Senate unanimously approved House Bill 203 by a vote of 20 to zero on Monday. Sponsored by the House Finance Committee, HB 203 further clarifies the definition of income that AIDEA uses to determine the dividend it will pay back to the state. HB 203 excludes expenses recorded as a result of recognizing impairment losses on development projects owned and operated by the authority. Impairment losses do not require current or future cash expenditure. Impairment losses recognize a write-down of the carrying value of physical assets paid for in the past.
After a vote of reconsideration, HB 203 moves to the Governor.

05-09-03 : The Alaska House of Representatives approved House Bill 205 by a vote of 27 to eight and by a reconsideration vote of 33 to three on Friday. Sponsored by Rep. Lesil McGuire (R-Anchorage), HB 205 includes Peace Corps volunteers among the Alaskans who may leave the state for more than 180 days and continue to receive the Permanent Fund Dividend. HB 205 also allows the Department of Revenue investigate, prosecute, and fine up to $3000 against people who make fraudulent claims for the PFD.

HB 214 stipulates that unless an employer authorized the act that caused the damages, or acted recklessly or knowingly in approving of the act after it occurred, or the employee is of such a high rank that he or she is essentially the employer, then the employee's punitive damages should not be awarded against the employer.

HB 227 raises the jurisdictional limit for district courts from $50,000 to $75,000, this bill will allow for increases in inflation and provide increased flexibility for litigants regarding whether to file in district court or superior court. HB 227 was amended to:

· Increased the jurisdictional limit for district courts from $50,000 to $100,000 (original bill only increased it to $75,000).
· Expanded the jurisdiction of district court to include actions for false imprisonment, libel, slander, and malicious prosecution.
· Added a provision limiting magistrates from hearing certain small claims cases when service is made on a defendant outside the state.

HB 241 gives municipalities an option to provide an exemption up to $50,000 on residential property taxes, with a vote of the people for such an ordinance. The exemption cannot affect taxes levied in a service area. HB 241 also increases the tax exemption on real property from $5,000 to $25,000 for a volunteer fire fighter or emergency medical services worker. Amended in Finance to bring into compliance with federal law dealing with HUD and other federal program which might be in effect programs.

Sponsored by the House Rules Committee on request of the governor, HB 245 provides that a person may not bring a lawsuit for damages that arise out of search and rescue activities, or the failure to initiate search and rescue activities. It also provides that a lawsuit for damages may not be brought by or on behalf of a member of the military services against the State of Alaska, the Alaska National Guard or other part of the Alaska organized militia, or any other member of the military services, for death, personal injury, or other injury of a member of the military services, including the United States military, the Alaska National Guard or other parts of the Alaska organized militia, or the national guard of another state, incurred during or arising out of activities that were part of the member's military service. HB 245 also broadens immunity to cover injury or property damage sustained by any civilian defense worker, including authorized volunteers and employees, and to specify that the immunity extends to employees of the state or district as well as the agents and representatives of the state or district. Finally, HB 245 requires that decisions regarding forest management related to fire control and suppression should be prompted by sound forestry and firefighting principles, rather than concerns regarding possible tort liability.

Labor & Commerce Committee Substitute for HB 255 makes several improvements to Alaska's Wage and Hour Act. These amendments will better protect employees and Alaskan small business owners. Changes the way managers may be compensated. The January 2003 minimum wage increase inadvertently resulted in higher salaries for entry-level managers – an up to $8000 a year increase. This caused many small business owners to reduce their number of employees, costing Alaska jobs. This legislation seeks to remedy the situation and is the result of cooperation and negotiations between labor and business.

First, all references to a real estate "agent" have been replaced with real estate "licensee" to conform with the rest of the real estate statutes which use the term "licensee." Second, references to lessors and lessees have been added to the statute to reflect that the disclosure statute also applies to real estate lease transactions. Finally, HB 257 clarifies that a failure to disclose or obtain written consent as required by the statute does not give rise to a private cause of action, but can result in a disciplinary action against the licensee. However, in cases of fraud, misrepresentation or deceit, a person can bring an action against the real estate surety fund for damages. After a reconsideration vote, HB 257 will return to the House for concurrence.

HB 298 is effective only if a Percent of Market Value (POMV) constitutional amendment is approved by the voters during the 2004 general election and takes effect. HB 298 provides conforming language to existing statute to accommodate changing the constitutional requirement that all income of the Permanent Fund be deposited into the general fund to the more limiting appropriation mechanism of "up to 5%" of market value in the proposed POMV constitutional amendment and to recognize the merger of the Earnings Reserve Fund into the Permanent Fund. Amended to exempt section 1, 2 and 5 from sections 10 and 11.
