HB 336 changes existing law to provide that a person who knowingly does not comply with existing motor vehicle liability laws may not recover damages for non-economic loss suffered by that person while operating a motor vehicle; clarifies that punitive damages do not need to be part of the mandated offers of uninsured/underinsured motorist coverage; and clarifies that the mandated offers of uninsured/underinsured motorist coverage does not need to be made on excess or umbrella policies. HB 336 was amended in the Senate Judiciary Committee to provide that the limitations on damages do not apply if the driver of the other vehicle: (1) is cited for operating a motor vehicle while intoxicated; (2)intentionally caused the accident; (3) flees from the scene of the accident; (4) at the time of the accident, is in furtherance of an offense that is a felony.

HB 338 accomplishes two simple, but necessary, statutory changes that govern the entry age for attendance into public school and the process by which local school districts may allow early entry applicants to be accepted (1) adjusts the date certain, from August 15th to September 1st, by which a child must have attained the age of five for standard entry in kindergarten, (2) allows school boards to delegate the authority to admit younger students to their chief school administrator, thus relieving the boards from this minor administrative burden more appropriately left to career education professionals. Under HB 339, businesses are prohibited from using opt-out marketing plans or free trial periods, to sell goods and services, unless specific requirements and disclosures are made to the consumer. The intent of this legislation is to protect consumers by requiring the disclosure of all consumer obligations and details of enrollment and acceptance of free trial periods and closely related marketing schemes. Amended to require written notification before charging a customer under a free trial offer.

· The bond shall remain effect for three years following the denial or expiration of a license. $500 cap (vs. $1,000 cap in original bill)
· Only 2 rollovers allowed (4 in original bill)
· Lender must post a bond to get a license (no bond in original bill)
· Lender will be subject to closer scrutiny by Division of Banking
· Lender must offer consumer a payment plan option before initiating legal action to collect against a consumer in default, including sending a certified letter offering to assist consumer.
· There is a $700 cap on total damages lender can recover (in addition to face value of checKB] for collection efforts ($1,000 in original bill).
· Lender can only charge $15 per $100 loaned and NO OTHER FEES, CHARGES OR INTEREST OF ANY KIND. (original bill allowed for additional interest).
· There are specific disclosure requirements concerning fees, charges, penalties that were not in the original bill.
