The bill would allow ASLC to issue bonds utilizing future cash flow that is in excess of that needed for effective and efficient operation of corporation programs. ASLC predicts it can return $260 million to the state over a three-year period beginning in 2004; the proceeds from which would be available to finance capital projects. House Bill 404 would allow the state to issue more than $143 million in revenue bonds to pay for a variety of construction projects at schools and university campuses around the state.

House Bill 419, recommended by the Joint Legislative Salmon Industry Task Force, will allow fishermen to form regional seafood development associations to tax themselves, providing a stable funding source for marketing efforts. CS HB 419 (RES) clarifies that the first qualified organization to apply will be designated the regional seafood development association and more closely define the membership of the associations. Amended to require 30% of permit holders to attend before an election is valid. Then a majority of those attending constitutes a majority.

HB 427 would ensure those individuals or organizations wishing to serve as private guardians or conservators meet certain criteria, and register with the State. Amended for minor technical language. Amended to clarify that the appointment of a guardian ad litem shall occur only in limited circumstances when the respondent, as a result of incapacity, is truly incapable of articulating a position to their attorney. Also, the CS clarified that an attorney for a ward or respondent may be appointed as guardian ad litem in some cases, but the role of attorney in that situation ceases, since a guardian ad litem should not be appointed unless it is impossible for the attorney to operate under the traditional attorney-client model of advocating for the client's expressed wishes.

Under House Bill 428 Civil Penalty: Underage Alcohol Purchases, an adult who orders or receives an alcoholic beverage, for the purpose of selling, giving, or serving it to a person under the age of 21 years, can be civilly liable to the licensee for a penalty of a $1,000. Likewise, the parent or legal guardian of a minor that solicits an adult to violate AS 04.16.060, can be civilly liable for a penalty of $1,000 to the licensee from which the alcoholic beverage was purchased, ordered, or received.

Currently AS 29.35 gives a municipality the ability to cover the cost of the Enhanced 9-1-1 equipment through a surcharge of only sixty-five cents. This does not cover the cost of the dispatch or the labor. The burden of the cost for this service is borne by local property taxes and state revenues. This bill will shift some of the costs to the users of this service and provide substantial relief to stretched municipal budgets. The bill imposes a surcharge on a person who pleads guilty or nolo contendere to, or is convicted of, a crime if the person was arrested and taken to a correctional facility or is sentenced to a term of imprisonment. The amount of the surcharge depends on the seriousness of the crime: $100 for a felony and $50 for a misdemeanor. The bill also would impose a surcharge on a person placed on probation after conviction of a crime. The surcharge is collected only if the defendant's probation is revoked for a probation violation and the person was either arrested and taken to a correctional facility for the violation, or sentenced to prison for it. First, it would remove "lode mines," sometimes referred to as "hard-rock mines," from the current bonding "cap" of $750 per acre for mine reclamation responsibilities; the cap would remain in effect for placer mines. Second, it would replace the term "performance bond" with the term "financial assurance," and would list various ways to provide that assurance, in order to give mining companies and the state the flexibility to employ a variety of financial assurance vehicles. Third, it would create a mine reclamation trust fund, which would allow the build-up of an adequate reclamation fund through payments made over time and through the earnings on that fund.
