HB 513 changes the name from Child Support Enforcement Division to Child Support Services Division and keeps the clock running for the time an individual has to become current on back child support payments before drivers licenses revocation occurs. Currently if a person is behind and makes a single payment the time from which he or she loses their licenses starts over. This bill will not allow that to happen.

House Bill 514 has been introduced as an omnibus bill to help the Child Support Enforcement Division better serve the parents and children of Alaska. There are seven changes to the child support statutes. Each piece of this legislation attempts to remedy problems the agency has encountered over many years. This bill would change the existing statutory authority for a waste disposal permit program (AS 46.03.100) by reorganizing and supplementing it. That reorganized section would preserve the essential requirement to obtain authorization before conducting an operation that results in waste disposal. The bill would clarify that the proof of financial responsibility must cover managing and closing the facility to control or minimize the risk of release of unauthorized levels of pollutants to waters.

This legislation streamlines a technical definition for investment adviser representative that at present is redundant and, therefore, difficult to comprehend, gives the securities administrator the authority to fine a person who violates the Securities Act up to $100,000 for multiple, knowing or purposeful violations and gives to the securities administrator the authority to order restitution to the victim of a violation of the Act and lower the jurisdictional limit of the division for oversight of ANCSA corporation proxy matters to those corporations with more than 250 shareholders. Amendment removed the restriction which prohibits charging more than the action cost of procedure.

Without HB 531, a subsequent gas development entity could immediately lease land relinquished by the original lessee. In addition, land not currently leased remains subject to current over-the-counter standards. This bill initiates a permanent solution to these problems. CS HB 531 (RES) scraps the separate leasing process for shallow natural gas leasing and treats leasing of that commodity under the conventional oil and gas leasing provisions. Repealed several non-conforming statutes and conformed to HB 524 (An Act relating to the protection of land and water from waste disposal; providing for the regulation of waste management). It has been brought forward in response to strong citizen interest in the Mat-Su Valley and on the Kenai Peninsula, with input from several public meetings held at one time or another by the Alaska Department of Natural Resources (DNR), and the Senate Resources Committee. Amended to add a section regarding miners the one time transfer of an application to a licenses and clarified bonding requirements.

HB 542 lowers the limit of a project cost from $10,000 to $5,000, and expands the work that can be done by a specialty contractor. Current law allows unlicensed persons to act as contractors, when they are not. In fact, they compete with contractors and are not required to have a bond or insurance. Having no bond or insurance gives the consumer no protection from faulty work.. HB 542 remedies this problem.

HB 549 prohibits attorneys from contacting air crash victims. Amended to clarify that the prohibitions (relating to initiating contact with individuals injured or killed in an aircraft accident do not apply to the activities undertaken or the legal obligations that an air carrier or its insurers may have to provide a passenger with short-term assistance and retain a penalty of a class A misdemeanor but establishes a greater fine of the greater of $100,000 or the amount of the legal fees. Amended to lower the max fine from $100,000 to $10,000 or the greater of fine and legal fees.

HB 551 addresses this issue by requiring the Department of Education revoke the teaching certificate of a person convicted of felony drug charges and also disallows a person from being granted such a certificate if they have been convicted of these charges. Amended on the floor to allow discretion in rehiring under certain circumstances and remove certain crimes as disqualifiers. Amended to include a 10 year look-back.

HB 553 is effective only if a Percent of Market Value (POMV) constitutional amendment is approved by the voters during the 2004 general election and takes effect. HB 553 provides conforming language to existing statue to accommodate changing the constitutional requirement that all income of the Permanent Fund be deposited into the general fund to the more limiting appropriation mechanism of 'up to 5%' of market value in the proposed POMV constitutional amendments which protect the fund's principal.

A recent Alaska Supreme Court decision has called into question the Railroad's exemption from local planning and zoning ordinances provided in AS 42.40 (Alaska Railroad Corporation). This bill would clarify the Legislature's intent that such local regulations do not apply to the Railroad's land unless it is leased to another person without retaining a railroad right of use.
