SB 35 was sent back to the Senate Finance Committee March 19. It passed the Senate March 8, but the effective date vote failed 11 to 7 (requires two-thirds or 14 votes) and the Constitutional Budget Reserve vote failed 11 to 7 (requires three-quarters or 15 votes). SB 35 appropriates the governor's recommended $754,613,200 for public K-12 education and $649,322,300 for the University of Alaska. If the CBR sections had passed, SB 35 would have appropriated an additional $82 million to K-12, equating to a $407 increase in the base student allocation, and an additional $5.8 million to the university. The CBR draw would have: made up possible shortfalls in the FY 04 and 05 operating budgets; restored money to be transferred into the CBR on June 30, 2004 under a constitutional provision requiring that general fund sub-accounts be "swept" into the Budget Reserve at the end of each fiscal year; and covered $125,000 for the CBR's 2005 investment management fees. Depending on the amount of funding approved, further legislation must be passed to adjust the base student allocation in the state's foundation formula. The bill is contingent on passage of the education foundation formula increase.

On May 11, the Senate unanimously passed House amendments made to SB 65. Authorizes the Department of Corrections to enter into agreements with Fairbanks North Star Borough, Matanuska-Susitna Borough, Bethel, and the Municipality of Anchorage for new or expanded correctional facilities; authorizes the Department of Corrections to enter into an agreement for correctional facility space and services in the City of Whittier with a third-party contractor; and authorizes issuance of certificates of participation for upgrade, expansion of replacement of jails in Dillingham and Kodiak. The bill requires a feasibility study to determine whether the state can provide these services for the same or less cost than a third-party operator, requires a competitive bid process, adherence to the state procurement procedures, and approval of the facility design by the Commissioner of Corrections prior to entering into an agreement. Further, the bill requires that all correctional officers, probation officers and parole officers be certified by the Alaska Police Standards Council.

Passed on recosideration May 7 by a vote of 11 to 9. Court Rules failed 12 to 8, which essentially voids the bill. Effective Date failed 12 to 8. It is similar to House Bill 145, which was passed last year and recently struck down in Juneau Superior Court. HB 145 eliminated the exemption for public interest litigants from the requirement that holds losing parties responsible for the winning side's attorney's fees and costs. The judge ruled HB 145 was improperly enacted because it required a two-thirds vote and was passed with a majority. SB 97 enacts changes similar to HB 145, but does so as rule changes and calls for a two-thirds vote. It applies the changes more broadly to all types of civil actions, regardless of whether they are related to resource development.
