Juneau -- The Alaska House of Representatives Thursday passed House Bill 318, sponsored by Representative Con Bunde (R-Anchorage). HB 318 allows private individuals who responsibly deliver property to a law enforcement agency to own that property after one year if possession of that property by that private individual is otherwise legal. "Common Law, the basis of modern-day law, provides that a private individual who finds property and takes the responsibility of giving it into safekeeping has a greater right to that property than anyone besides the true owner," Bunde said. "HB 318 modifies Alaska statutes to provide clear guidance to State departments and law enforcement agencies about what they may, or may not, do when an individual turns-in found property." HB 318 is designed to encourage individuals to turn found property over to law enforcement agencies. It does not affect existing municipal ordinances. HB 318 passed the House unanimously and now moves to the Senate for consideration.
