Senate Considers Single Gender Health Clubs Bill

Juneau -- Senate Bill 176, which would allow gender-based health clubs to provide services to single-gender members, is expected to reach the Senate floor for a vote soon. SB 176 is sponsored by Senator Drue Pearce (R - Anchorage).

"Privacy is a right that is established under the Alaska Constitution. SB 176 would provide a means of protecting an individual's right to privacy," said Senator Pearce. "Gender-based health clubs offer a secluded environment allowing people to feel more at ease in what is often an intimidating setting. This measure would recognize male-only or female-only health clubs based on membership and employment."

This legislation was drafted following an action filed by The Alaska Human Rights Commission (AHRC) against the Anchorage Women's Club. The commission decided that the Club unlawfully discriminates against men because it is a place of public accommodation. AHRC based their decision on Alaska Statute 18.80.230, which prohibits discrimination based on gender in places of accommodation, such as restaurants, bars, theaters, pools, golf courses, hotels and motels. Health clubs are not listed in AS 18.80.300 as places of accommodation, opening the door for Senator Pearce's bill.

The Surgeon General's Report on Physical Activity and Health states that regular exercise "reduces the risk of developing or dying from some of the leading causes of illness and death in the United States." SB 176 is an important piece of legislation because it would prevent having to work out with the opposite gender from being a roadblock to those who are seeking the health benefits of exercise.

"It is important to note that this bill allows private membership health facilities to cater to one gender. Men or women who choose to do so would be able to exercise in a single gender environment," said Pearce.

Alaska is not the first state to consider allowing single-gender health clubs. Colorado, Hawaii, Illinois, New Jersey, New York, Pennsylvania and Tennessee have all authorized the existence of same gender fitness and wellness centers.
