SUBJECT: Sectional Summary of HB 32; An Act relating to big game hunting by nonresident members of the military service.

You have requested a sectional summary of HB 32; An Act relating to big game hunting by nonresident members of the military service.

As a preliminary matter, note that a sectional summary of a bill is not an authoritative interpretation of the bill. The bill itself is the best statement of its contents.

Section 1 of the bill amends AS 16.05.340(d) to provide that nonresidents in the military who are on active duty and permanently stationed in the state (and dependents of the nonresident) may obtain a special nonresident military license to hunt in the state. The fee for the license is the same as the fee for a resident hunting license. A person who has a special nonresident military hunting license may not take a brown bear or musk ox, unless the person first obtains a tag for that species. The fee for the tag is the same as that which a resident would pay for the tag.

Section 2 of the bill amends AS 16.05.407(a) to provide that a nonresident in the military who is on active duty and permanently stationed in the state (and dependents of the nonresident) may hunt, pursue, or take brown bear, grizzly bear, mountain goat, or sheep without being accompanied by a licensed guide or a resident who is related by blood or marriage to the nonresident (or the dependent).

Section 3 of the bill provides that the bill takes effect January 1, 1998.
