An Act Relating to the Consumer Price Index

Section 1: Adds a new section to 01.10.060 to provide that "consumer price index" means the Consumer Price Indexes, All Items Indexes, All Urban Consumers, U. S. City Average, compiled by the Bureau of Labor Statistics, United States Department of Labor.

Section 2: AS 09.38.115. Code of Civil Procedure -- Alaska Exemptions Act -- Adjustment of dollar amounts. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 3: AS 09.55.548(a). Code of Civil Procedure -- Special Actions and Proceedings – Awards, collateral source. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 4: AS 14.25.143(f). Education, Libraries & Museums -- Teachers’ Retirement -- Post retirement pension adjustment. Adds language stating that notwithstanding the language in Section 1 that for an employee who first became a member of the system before the effective date of this act that the consumer price index for urban wage earners and clerical workers for Anchorage, Alaska, is still the consumer price index used. For an employee first hired on or after the effective date, an increase in benefit payments is calculated on the consumer price index as defined in Section 1.

Section 5: AS 14.56.330(b). Education, Libraries & Museums -- State & Community Libraries -- Limitations. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 6: AS 18.20.340. Health, Safety & Housing – Hospitals – Civil fines. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 7: AS 21.42.365(b). Insurance – The Insurance Contract – Coverage for treatment of alcoholism or drug abuse. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 8. AS 21.55.120(a). Insurance – State Health Insurance – deductibles and copayments. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 9. AS 21.55.120(c). Insurance – State Health Insurance – deductibles and copayments. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 10. AS 26.05.260(b). Military Affairs and Veterans – Military Code of Alaska – Pay and allowances. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 11. AS 34.08.820(a). Property – Common Interest Ownership – Adjustment of dollar amounts. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language only for those planned communities created on or after the effective date of this Act.

Section 12. AS 37.05.540(b). Public Finance – Fiscal Procedures Act – Budget reserve fund; appropriation limit. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 13. AS 37.13.145(c). Public Finance – Alaska Permanent Fund and Corporation – Disposition of income. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 14. AS 38.05.211(d). Public Land – Alaska Land Act – annual rental. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language only for those mining claims, leasehold locations, and mining leases first acquired on or after the effective date of this section.

Section 15. AS 38.05.321(h). Public Land – Alaska Land Act – restriction on sale, lease or other disposal of agricultural land. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language

Section 16. AS 39.27.011(e). Public officers and Employees – Pay Plan for State Employees – Salary schedule. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language

Section 17. AS 39.27.011(f). ). Public officers and Employees – Pay Plan for State Employees – Salary schedule. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language

Section 18. AS 39.27.011(g). Public officers and Employees – Pay Plan for State Employees – Salary schedule. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language.

Section 19. AS 39.35.475(f). Public Officers and Employees – Public Employees’ Retirement System of Alaska – post-retirement pension adjustment.

Section 20. AS 46.04.045(a). Water, Air, Energy, and Environmental conservation – Oil and Hazardous Substance Pollution Control – Adjustment of dollar amounts. Changes the current language regarding consumer price index for Anchorage to reflect Section 1 language only for those proofs of responsibility first submitted on or after the effective date of this Act.

Section 21. AS 21.55.120(d). Insurance – State Health Insurance – deductibles and copayments. Current subsection (d) repealed; this subsection described the consumer price index as the all urban consumers for the Anchorage Metropolitan Area index.

Section 22. Applicability. States that various sections of the bill only impact items entered into on or after the effective date of this act.

Section 23. Effective date. January 1, 1999.
